What's the difference between a clerk not enforcing gay marriage law and a president not enforcing IRS law?

The IRS is specifically prohibited by law from using the selective targeting of specific political viewpoints in determining tax exempt status.

Why aren't Obama and Holder and Lerner in jail for refusing to enforce the law?
